Former Obama Attorney General Eric Holder says it’s very likely that special counsel Robert Mueller has already made a decision to charge President Donald J. Trump with obstruction of justice over his firing of FBI Director James Comey — which means that the fix was in all along to ‘get’ Trump.
As reported by The Daily Caller, Holder, in an appearance on the Alt-Left host Bill Maher’s HBO program Friday, says that Mueller hasn’t actually charged Trump yet because he’s holding off until he has him dead to rights.
Holder has made similar statements in the past, The DC noted.
“I’ve known Bob Mueller for 20, 30 years,” said Holder. “My guess is he’s just trying to make the case as good as he possibly can. So I think that we have to be patient in that regard.”
Holder is one of those Trump haters who has long suggested that the president should be held criminally liable for firing Comey during an FBI investigation into alleged ‘Trump-Russia collusion’ — of which there has never been any evidence. Indeed, House Intelligence Committee Chairman Devin Nunes, R-Calif., said that the only “Russian collusion” his committee has found is between Moscow and the Hillary Clinton campaign.
As for Holder’s prediction, real constitutional experts dispute it outright because it has no legal basis.
“You cannot charge a president with obstruction of justice for exercising his constitutional power to fire Comey and his constitutional authority to tell the Justice Department who to investigate, who not to investigate,” said Harvard Law Prof. Alan Dershowitz in an interview in December.
In an earlier interview with CNN in May 2017, Dershowitz said there are are two remedies for those who are outraged over Trump’s firing of Comey after the president reportedly pressed Comey to drop his investigation of Flynn – “amend the Constitution, [or] don’t vote for him.”
“But don’t try to expand the existing criminal law in violation of civil liberties to do what Stalin did, where [secret police chief Lavrentiy] Beria said, ‘Show me the man, I’ll give you the crime,’” Dershowitz said. “That’s not America.”
As for impeaching Trump, that’s a political solution, Dershowitz stressed.
However, he added, “there’s not that much new that would warrant either an impeachment, certainly not a criminal prosecution” by Mueller.
And nothing has changed since then — except that Congress is a lot closer to the truth of what really happened between an American presidential campaign and the Russians, and as many suspected, Hillary Clinton’s fingerprints are all over it.
Still, one other expert believes that Mueller’s ultimate goal is the impeachment of Trump. Former national security federal prosecutor Andrew McCarthy has written that it’s impossible to claim that Trump ‘obstructed’ the FBI’s Russian collusion probe because it is a counterintelligence investigation, not a criminal probe — and counterintelligence investigations are done specifically to inform the president of outside threats.
As such, he believes Mueller’s probe all along has been designed to provide a Democrat-controlled Congress (should that happen) with a reason to impeach Trump. (Related: Is Mueller timing release of his findings to SABOTAGE the GOP and Trump in time for 2018 elections?)
“Since there is no collusion case, we can safely assume Mueller is primarily scrutinizing President Trump with an eye toward making a case of obstructing an FBI investigation. This also makes sense in light of the pleas that have been taken,” he wrote.
“I continue to believe that this is the real danger for President Trump: A report by the special counsel, either through the grand jury or some other vehicle, concluding (a) that the president had obstructed the FBI’s investigation of [former national security advisor Michael] Flynn and of Trump-campaign collusion with Russia, and (b) recommending that the matter be referred to Congress for consideration of next steps, potentially including impeachment and removal,” he added.
Regardless of whether he’s factually correct or not, consider Holder’s latest proclamation about the president’s political future a warning that the Deep State remains engaged in its operation to deep six his administration.
