Presidential son Hunter Biden dropped an earlier lawsuit he filed against Fox News just hours after President Joe Biden announced that he won’t be seeking a second term.
According to CNN, the younger Biden abruptly dropped a lawsuit he filed last month against Fox News over the network’s fictionalized miniseries. He alleged that it included sexually explicit images of him without consent.
The July 21 notice of voluntary dismissal was submitted to the U.S. District Court for the Southern District of New York by Tina Glandian, an attorney at the Geragos & Geragos law firm.
The move came less than a month after Hunter filed the lawsuit late last month. He accused the Rupert Murdoch-owned network of unlawfully publishing “intimate images” of him in a now-scrubbed 2022 miniseries about his legal troubles. These images were reportedly included in the so-called “laptop from hell” that originally belonged to him.
The miniseries in question was titled “The Trial of Hunter Biden.” This six-part series featured a dramatized “mock trial” about the presidential son’s overseas financial dealings. The series led, in part, to his federal tax indictment and claims that fueled House Republicans’ stalled impeachment inquiry into the elder Biden.
Geragos & Geragos initially threatened to take legal action against the conservative network. In an April 23 letter signed by Glandian, the law firm accused Fox News of “conspiracy and subsequent actions to defame [the younger] Biden and paint him in a false light.” It also accused Fox News and Fox News Digital of “the unlicensed commercial exploitation of his image, name and likeness” and “the unlawful publication of hacked intimate images of him.”
“For the last five years, Fox News has relentlessly attacked Hunter Biden and made him a caricature to boost ratings and for its financial gain. We plan on holding them accountable,” the law firm said in a statement. The network complied with the letter and removed the six-part miniseries from its platforms.
“This program was produced in and has been available since 2022,” Fox News told Mediaite in April. “We are reviewing the concerns that have just been raised and – out of an abundance of caution in the interim – have taken it down.”
Despite this, Hunter went ahead with filing the lawsuit in New York City on June 30. He accused the network of targeting him “in an effort to harass, annoy, alarm and humiliate him, and tarnish his reputation.” The presidential son also alleged that Fox News violated Section 52-b of the New York Civil Rights Law, which covers so-called “revenge porn” – spreading a person’s nude images without their consent to malign them. “Far from reporting on a newsworthy event, Fox News sought to commercialize [Hunter] Biden’s personality through a form of treatment distinct from the dissemination of news or information,” the lawsuit stated. “Indeed, the entire miniseries is fictionalized and based on a nonexistent criminal case.”
The network pushed back against the complaint in a statement to Mediaite, calling it an “entirely politically motivated lawsuit” that is “devoid of merit.”
“Hunter Biden is a public figure who has been the subject of multiple investigations and is now a convicted felon. Consistent with the First Amendment, Fox News has accurately covered the newsworthy events of [Hunter’s] own making, and we look forward to vindicating our rights in court,” the statement continued.
Before Hunter’s decision to voluntarily drop the lawsuit, it had been in the courts for less than a month. On the same day as the lawsuit’s withdrawal, the younger Biden released a statement praising his 81-year-old father’s historic decision to bow out of the 2024 presidential race.
“I’m so lucky every night I get to tell him I love him and to thank him,” Hunter wrote. “I ask all Americans to join me in doing the same. Thank you, Mr. President. I love you, Dad.”
